DMCA Policy

"Black Bean Chili" respects the intellectual property rights of others and is committed to complying with U.S. copyright law, including the Digital Millennium Copyright Act (DMCA). This policy outlines our procedures for addressing alleged copyright infringement on our website and for submitting counter-notifications.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the "Black Bean Chili" website, please notify us by submitting a DMCA Takedown Notice as described below.

Filing a DMCA Takedown Notice

To file a DMCA takedown notice, please provide our Copyright Agent with the following information in writing:

  1. Identification of the copyrighted work: A detailed description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works. Please include information sufficient to permit us to locate the material (e.g., a URL link to the original work, title, author).
  2. Identification of the infringing material: A description of the material that you claim is infringing and its location on the "Black Bean Chili" website (e.g., the specific URL of the page containing the recipe, image, or text).
  3. Your contact information: Your full legal name, mailing address, telephone number, and email address.

Upon receipt of a valid DMCA Takedown Notice, we will remove or disable access to the infringing material and take reasonable steps to notify the user who posted the material.

Filing a DMCA Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. Your counter-notification must include the following:

  • Identification of the removed material: Identification of the specific material that was removed or to which access was disabled, and the location (e.g., URL) at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your contact information: Your full legal name, mailing address, telephone number, and email address.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the U.S., for any judicial district in which "Black Bean Chili" may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward a copy to the original complainant. Unless the copyright owner files an action seeking a court order against the user, the removed material may be replaced or access to it restored within 10 to 14 business days after receipt of the counter-notification.
